CAT certifies Consumer Class Action Against Amazon Over Buy Box Dispute

Yesterday, the consumer class action 1595/7/7/23 Robert Hammond v Amazon.com was certified by the CAT.

Evidence from Fideres had proved decisive in 2023-2024 when Mr Hammond became the first to win a contested carriage dispute in the UK with the CAT finding that Fideres’s expert report was “clearly and distinctly better” than the rival class’s expert economic report. Having done so, the CAT yesterday proceeded to approve the methodology set out by Dr Pike for assessing whether Amazon has abused its dominance by manipulating the algorithm that it uses to select the default offer that Consumer’s purchase when they click “Add to Cart” or “Buy Now” (the so-called ‘Buy Box’). Mr. Hammond’s case will now proceed to disclosure and trial, with a date to be confirmed in due course.
